By installing, accessing, or using ProdKit AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users of the Service.

2. Description of Service

ProdKit AI is a Shopify application that provides AI-powered content generation tools, including but not limited to product descriptions, blog posts, images, logos, and SEO optimization features. The Service is designed to help Shopify merchants create and enhance their e-commerce content.

3. User Accounts and Registration

To use the Service, you must have a valid Shopify store and complete the installation process. You are responsible for:

  • Maintaining the security of your Shopify account
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

4. Subscription Plans and Billing

We offer various subscription plans with different features and usage limits. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis
  • Billing occurs monthly unless otherwise specified
  • You can upgrade, downgrade, or cancel your subscription at any time
  • Refunds are handled according to Shopify's billing policies
  • Usage limits reset at the beginning of each billing cycle

5. Acceptable Use Policy

You agree not to use the Service to:

  • Generate content that is illegal, harmful, or violates any laws
  • Create misleading, false, or deceptive product information
  • Infringe on intellectual property rights of others
  • Generate content that is discriminatory, hateful, or offensive
  • Violate Shopify's Terms of Service or Acceptable Use Policy
  • Attempt to reverse engineer or exploit the Service
  • Use the Service for any automated or bulk processing without permission

6. Intellectual Property Rights

Content generated through the Service:

  • You retain ownership of content you create using our tools
  • You are responsible for ensuring generated content complies with applicable laws
  • We retain no rights to your generated content
  • The Service itself and its underlying technology remain our property

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Service Availability and Modifications

We strive to provide reliable service, but:

  • The Service may be temporarily unavailable due to maintenance or technical issues
  • We may modify, suspend, or discontinue features at any time
  • We will provide reasonable notice for significant changes when possible
  • We do not guarantee uninterrupted or error-free operation

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless ProdKit AI and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

Either party may terminate these Terms:

  • You may uninstall the app at any time from your Shopify admin
  • We may terminate your access for violations of these Terms
  • Upon termination, your data will be deleted according to our Privacy Policy
  • Termination does not affect any outstanding payment obligations

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration or in the appropriate courts, as determined by applicable law and jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated through the app or via email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

15. Severability
